A Women24 reader recently wrote to us for advice on the amount of leave her domestic worker is entitled to.
Her employee works every Tuesday for eight hours and every Thursday, for three hours.
So, the question is, how much leave is the employee due?
Karel van der Molen, Women24’s resident Work and Money expert says there are two things to keep in mind.
1. Your domestic worker needs a formal contract of employment
It is important that you (and other employers of domestic workers) must have a formal and properly drafted contract of employment, the terms and conditions of which have been discussed and negotiated and agreed to by both parties.
There is a sample contract available on the website of the Department of Labour.
2. The same rules do not apply for part time and full time workers
There are different rules and regulations when it comes to employees that work less than 24hours a month for an employer.
So, how does it work?
The annual leave entitlement is 21 days, but if the employer and employee agree, the latter can take leave as follows: one day for every 17 days worked or one hour for every 17 hours worked.
