I want to get a divorce but I want to keep my home – how do I do it?

I’m considering a divorce and want to keep our house. Am I forced to sell, or can I keep it? You previously advised someone that they had the option to buy their partner out. What if I don’t have the money, want to stay in the house and my husband is the one who applied for the divorce?

During a divorce you have an option of buying out your ex-spouse or selling the house. If you don’t have the money to buy your ex-spouse out, you have no choice but to sell the house.

This applies even if the divorce was initiated by your husband. Even if he has an affair you will still be forced to sell the house if you cannot buy him out.

There’s no law that says an adult must work. But there is a law that states that married spouses are legally obliged to support each other.

My husband refuses to work, saying he doesn’t have to since we’re renting out properties and that the income is enough to sustain us. The reality is that isn’t true. We aren’t financially stable and have lots of debt we’re still paying. How can I divorce him without sharing assets?

There’s no law that says an adult must work. But there is a law that states that married spouses are legally obliged to support each other. If you are married in community of property, 50% of all assets belong to your husband and you have no choice but to share all assets. Assets aren’t the only things that will be shared, debts will be shared as well.
