Dividing the assets of a loved one can lead to tension and resentment, and make one upset. In the past decade, the number of wills contested in New South Wales, Australia increased by 52 percent and in Victoria, disputes over wills increased by about 73 percent. A 2015 study found adult children are most likely to contest a will, followed by a partner or ex-partner.
Increasingly complex family arrangements are also contributing to the fact that more wills are being disputed in court or through mediation. Stepfamilies Australia says there are upwards of 99 000 stepfamilies with children under the age of 18 in Australia, and a further 91 000 blended families.
