The outcome of the ANC vs MK Party case that began on Wednesday should, hopefully, provide further clarity on the subject of proprietary rights over party names and historical events, writes Mcebisi Ndletyana. 

The Electoral Court’s decision on Tuesday was not surprising. It was self-evident, from the ANC's own submissions, that it was hoping for a miracle. 

The party's legal challenge of the use of the name uMkhonto WeSizwe, and its logo, by the newly formed uMkhonto weSizwe (MK) Party, however, is far from over. The legal wrangle is continuing on Wednesday in the Durban High Court. While challenging the Electoral Commission of South Africa (IEC) in the Electoral Court, it turned out the governing party had also initiated another case but is arguing it on different grounds.
