EFF leader Julius Malema did not ask a single question at the Judicial Service Commission's interviews of aspirant Supreme Court of Appeal judges – in a process that was dominated by questions on competence, not politics.

"Monday's interviews continue an encouraging trend of the JSC focusing on candidates' understanding of the law and their judgments. Questioning has been rigorous and at times tough, but has generally been focused on the criteria, without the harassment and ambushing of candidates which have been seen in past interviews," Freedom Under Law (FUL) research consultant Chris Oxtoby told News24.

In April, and after considerable pressure from FUL, Judges Matter, the Council for the Advancement of the SA Constitution (CASAC), Helen Suzman Foundation and other civil organisations, the JSC adopted a 10-page set of "guidelines for questioning candidates for judicial appointment to the Constitutional Court adopted in 1994; and the criteria for judicial selection adopted in 2010".
