The Western Cape High Court dismissed Tauriq Jenkins' leave to appeal aspects of a judgment that not only paved the way for unhindered construction at Cape Town's new Amazon complex, but also inferred that he was a fraud.
"The appeal is moot, and it is also not in the interests of justice to grant leave to appeal," the judgment read.
Judge Elizabeth Baartman, with judges James Lekhuleni and Hayley Slingers concurring, said punitive costs would not be awarded as requested, even though they deemed his case "an abuse of process".
