The Supreme Court of Appeal (SCA) upheld the Western Cape government's appeal in the controversial Tafelberg case, which stems from the provincial government's decision to sell prime property in Sea Point instead of using it for housing.
The SCA handed down the judgment on Friday morning and set aside two previous orders by the Western Cape High Court, which declared the sale of a Sea Point property, known as the Tafelberg site, unlawful.
The site has been the subject of a heated court battle between the housing activist group, Reclaim the City, and the Western Cape government.
